Recent visits to five Latin American nations indicate that some medical professionals are eager to increase the role of bioethics in their countries. Conversations with key figures there point up similarities and differences among Latin nations, and between Latin countries and the United States, in their approaches to ethics. Opportunities exist for U.S. bioethicists to help get bioethics teaching and research off the ground in Latin America.

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this paper we shall prove that certain subvarieties of the variety of Salgebras (Heyting algebras with successor) has amalgamation. This result together with an appropriate version of Theorem 1 of [L. L. Maksimova, Craig’s theorem in superintuitionistic logics and amalgamable varieties of pseudo-boolean algebras, Algebra i Logika, 16(6):643-681, 1977] allows us to show interpolation in the calculus IPC S (n), associated with these varieties.We use that every algebra in any of the varieties of S-algebras studied in this work has (...) a canonical extension, to show completeness of the calculus IPC S (n) with respect to appropriate Kripke models. Results showed that the benefits derived from the program were topped by enhancement of skills on basic leadership with emphases on the ability to listen and ability to communicate which were rated very important and very much benefited among other (...) training aspects of the program. Results also revealed that students are aware of the importance of physical, mental and social health as well as the observance of proper hygiene for overall sense of well-being. Although recreation is one aspect that the respondents find important, appreciation of it underscores the need to have more time for assignments and projects as most of the respondents are enrolled in their respective courses with 29 units, making them unable to appreciate the perks of involving themselves into various recreational activities. Problems in the implementation showed lack of provision of materials and equipment and of budgetary allocation which rendered full implementation weak as students and faculty involved in the community immersion have to rely on their own resources, in addition to the indifference and passivity of the local government officials. Based on the findings, the researchers recommended that: the school administrators need to allocate adequate budget for materials and equipment; periodic faculty development trainings and; to look into the passive attitude of the local officials to ensure that implementation NSTP projects will benefit both clients and implementers. ]]>. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

The purpose of this paper is to present a formalization of the language, semantics and axiomatization of justification logic in Coq. We present proofs in a natural deduction style derived from the axiomatic approach of justification logic. Additionally, we present possible world semantics in Coq based on Fitting models to formalize the semantic satisfaction of formulas. As an important result, with this implementation, it is possible to give a proof of soundness for $\mathsf{L}\mathsf{P}$ with respect to Fitting models.

L’article ici présenté essaye de reconstituer l’itinéraire intellectuel de Jaime Guzmán, architecte de l’ombre de la dictature de Pinochet, qui a élaboré une synthèse libérale-conservatrice pour essayer de justifier le libéralisme économique à partir du principe de subsidiarité. L’article interroge notamment la cohérence interne d’une telle synthèse, et par son caractère polémique.

We present a fully relational definition of inertial systems based in the No Arbitrariness Principle, that eliminates the need for absolute inertial frames of reference or distinguished reference systems as the ``fixed stars'' in order to formulate Newtonian mechanics. The historical roots of this approach to mechanics are discussed as well. The work is based in part in the constructivist perspective of space advanced by Piaget. We argue that inertial systems admit approximations and that what is of practical use are (...) precisely such approximations. We finally discuss a slightly larger class of systems that we call ``relatively inertial'' which are the fundamental systems in a relational view of mechanics. (shrink)

Austin, but later transformed by the Transcendental Pragmatics and the Theory of Communicative Action ; 2) the philosophical theory of Europe, based on Kant, Husserl, Ortega y Gasset and the communicative or discursive ethics; and 3) Philosophy of Peace that becomes in philosophy for making peace, overcoming violence, war and injustice: an interdisciplinary research based on intersubjectivity with ethical and political sense. While mechanics was developed under the idea of reciprocal action (interactions), electromagnetism, as we know it today, takes a form more akin to unilateral action. Interactions call for spatial relations, unilateral action calls for space, just one reference centre. In contrast, interactions are matters of relations that require at least two centres. The development of the relational electromagnetism encouraged by Gauss appears to stop around 1870 for reasons that are not completely clear but are certainly not solely scientific. By the (...) same time, Maxwell recognised the equivalence in formulae of his electromagnetism and the one advocated by Gauss and called for an explanation of why such theories so differently conceived have such a large part in common. In this work we reconstruct and update the relational electromagnetism up to the contributions of Lorentz guided by the non-arbitrariness principle (NAP) that requests arbitrary choices to be accompanied by groups of symmetries. We show that a-priori there must be two more symmetries in electromagnetism, one related to the breaking (in the description) of the relation source/detector and one relating all the perceptions of the same source by detectors moving with different (constant) relative velocities. We show that the idea of electromagnetic waves put forward in concept by Lorenz (1861-1863) before Maxwell (1865) and in formulae (1867) just after Maxwell, together with the ``least action principle'' proposed by Lorentz are enough to derive Maxwell's equations, the continuity equation and the Lorentz' force, and that there is a dual formulation in terms of fields of the receiver (as opposed to fields of the source). While Galilean transformations are associated with removing the arbitrariness implied in the election of a reference space, they will not explicitly appear in a formulation based upon a relational space although we occasionally mention their usefulness. In contrast, Lorentz' transformations will emerge in this formulation involving the relations between the perceived fields of different receivers. Moreover, the role of the full Poincaré-Lorentz group as a group of transformations of the perceived actions is elucidated. In summary, we answer Maxwell's philosophical question showing how the same theory in formulae can be abduced using different inferred entities. Each form of abduction implies as well an interpretation and a facilitation of the theoretical construction. This work relies heavily on logical concepts as abduction put forward by C. La arqueología ha revelado recientemente la existencia de una importante revitalización urbana en Córdoba durante el Califato Almohade, apenas tratada hasta ahora por la historiografía, centrada principalmente en su pasado omeya. Por un lado, se ha observado una importante inversión del poder almohade en elementos defensivos y palatinos, acaso por tratarse en estas fechas de un centro fundamental en la conceptualización histórica de al-Andalus y en la lucha contra los reinos cristianos; por otro, se ha documentado un importante crecimiento orgánico (...) y privado extramuros. Todo ello coincidió con su elección como capital andalusí en 557/1162 por ‘Abd al-Mu’min, lo que suponía un hito fundamental para la legitimación de su nuevo califato. Tras su muerte pocos meses después, Abū Ya‘qūb Yūsuf hizo regresar la corte a Sevilla, creando un importante cambio de rumbo en la política almohade que no afectó al resurgir urbano de la antigua sede omeya. En realidad, Córdoba seguiría muy presente en la mentalidad colectiva andalusí durante el gobierno almohade, manteniéndose como referente principal del esplendor pasado y como núcleo esencial de la tradición mālikī. The prospective formalization of the Anthropocene as a chronostratigraphic unit by the International Commission on Stratigraphy has been intensely debated. This paper explores and assesses the stakes of this process from a philosophical perspective. I distinguish two senses of formalization—the descriptive and the evaluative—and argue that: 1) there are descriptive and evaluative formalizations of the Anthropocene beyond the confines of the ICS; 2) incoherencies between Anthropocene proposals and the ICS’s current tenets are not a decisive reason for deferring descriptive formalization; (...) and 3) the prospective evaluative formalization of the Anthropocene by the ICS would be impactful. Este artículo presenta una reflexión política acerca del VIH-sida, estructurada en cuatro momentos: primero, una aproximación a las políticas de la vida donde se devela el actuar de la necropolítica, el biopoder, la biopolítica y biolegitimidad en relación con el VIH-sida; segundo, se aborda una antropología política del cuerpo, la cual advierte las distintas formas de poder, violencia y verdad que experimentan las personas que viven con VIH-sida; tercero, un acercamiento al modo en que se reproduce una economía moral del (...) castigo, donde se articulan elementos normativos, médico-sanitarios, de la vida, el cuerpo y la sociedad; cuarto, se propone repolitizar el VIH-sida, a fin de brindar insumos que permitan construir un orden social diferente para las personas que viven con dicha realidad. The purpose of this study was to analyze the attitude of a group of cardiologists on the ethical conducts they would accept or adopt when encountered with different hypothetical situations of medical practice. Between August and September of 2011, 700 Argentine cardiologists were surveyed in situations which posed ethical dilemmas in the patient-physician relationship, among colleagues or involving financial agreements with employers or the pharmaceutical industry. Ethical conflicts were evidenced in a series of inappropriate conducts such as differential fees, trips (...) and meals sponsored by laboratories, splitting fees, overbilling, self-referral, charging for patient referral, financial compensation for ordering medical procedures, and various situations derived from the relationship with employers. In general, financial compensation from the pharmaceutical industry was more accepted than the conflictive situations which directly involved patients, colleagues or employers. The rejection of these conducts, the physicians' deontological education and the improvement of financial and organizational conditions in medical practice will help to encourage better medical professionalism and avoid unseemly behaviors. This paper argues that epistemic errors rooted in group- or identity- based biases, especially those pertaining to disability, are undertheorized in the literature on medical error. After sketching dominant taxonomies of medical error, we turn to the field of social epistemology to understand the role that epistemic schemas play in contributing to medical errors that disproportionately affect patients from marginalized social groups. We examine the effects of this unequal distribution through a detailed case study of ableism. There are four primary (...) mechanisms through which the epistemic schema of ableism distorts communication between nondisabled physicians and disabled patients: testimonial injustice, epistemic overconfidence, epistemic erasure, and epistemic derailing. Measures against epistemic injustices in general and against schema-based medical errors in particular are ultimately issues of justice that must be better addressed at all levels of health care practice. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. Se estudian algunas reacciones en América Latina y se describe el proceso por el cual Renan llegó posteriormente a ser aceptado por círculos conservadores. The French historian Ernest Renan published in 1863 a Life of Jesus that questioned his divinity. The book aroused scandal and attempts of rebuttal. Se adapta al título del libro de Andre Gunder Frank para proponer un esquema de conjunto de la historia americana desde una visión no eurocéntrica y desde la historia mundial. El acento no se coloca en la relación del continente con la Europa mediterránea o atlántica, ni en procesos endógenos, sino en los contactos que mantuvo con las otras civilizaciones del Viejo Mundo: África, la Europa oriental, Rusia, el Medio Oriente, India, China y el Pacífico. Se argumenta que antes de (...) la llegada europea hubo una etapa fuertemente influida por las relaciones con Asia. Éstas continuaron aún en época colonial, en términos comerciales, demográficos y artísticos, junto a una fuerte inmigración e influencia cultural africana. Si bien la independencia supuso una serie de ilusiones sobre el fomento de las relaciones con Asia, el siglo xix fue de creciente influencia europea (demográfica, militar, política, económica, cultural). El esquema propuesto puede servir para entender mejor los procesos por los cuales en nuestros días América, como el resto del mundo, está entrando nuevamente en la órbita asiática. (shrink)

During the second half of the nineteenth century, electronegativity has been one of the most relevant chemical concepts to explain the relationships between chemical substances and their possible reactions. Specifically, EN is a property of the substances that allows them to attract external electrons in bonding situations. The problem arises because EN cannot be measured directly. Indeed, the only way to measure it is through different properties that do can be directly measured, for instance enthalpy, ionization energies or electron affinities. (...) What is particularly troubling about this case in quantum chemistry is that the different models used to describe and quantify EN are incompatible but, in a certain sense, equivalent because the same EN scale results in all of them. By analyzing Linus Pauling’s and Robert Mulliken’s models of EN, it will be argued that, if we remain cling to a traditional representative conception of models, we cannot understand the meaning of the information provided by those models. Indeed, if we do not want to adopt an instrumentalist point of view concerning chemical knowledge, we should reconsider by virtue of what a model represents the system, or, in other words, which the factors that determine the representative power of a model are. I will propose a new perspective that incorporates the role of experimental techniques in the very notion of representation; this perspective allows us to understand how supposedly incompatible models of the same target system can be both simultaneously representative. The incompatibility within the context of modeling cannot be established simpliciter. The fact that modeling is understood as an activity whose representational power can only be partially established, may minimize the supposed existence of incompatible models. Indeed, it is argued from perspectivism that incompatibility can be dissolved, meaning that it becomes trivial or simply false due to the inherently pragmatic and partial nature of the act of representation and modeling. From this perspective, incompatibility can only be a consequence of a (...) misunderstanding of the very nature of modeling and representation In this sense, in order to tackle this strategy at its root from perspectivism, we will first need to outline the maximal perspectivism thesis, attempting to identify the possible escape routes that perspectivism could find in order to explain incompatibility as an illusory incompatibility. Then, we will analyze Valence Bond Model and Molecular Model of covalent bonds, and we will conclude that the dissuasive strategies used to minimize and/or disregard incompatibility prove to be fruitless. Situados en un progresivo traspaso de responsabilidades en la ejecución de los servicios sociales desde el Estado hacia actores no gubernamentales, aparece una demanda hacia el mismo Estado, el cual en lugar de simplemente declinar su labor, debiera de hecho expandir su regulación de modo de asegurar que la oferta social sea eficiente en satisfacer al ciudadano usuario en aquellos servicios prometidos por las políticas y programas sociales. Así mismo, la institucionalidad pública debiera reconocer las demandas del mundo privado para (...) actuar articuladamente hacia fines comunes, que finalmente conduzcan a un horizonte de desarrollo de una sociedad más igualitaria. Este estudio da cuenta de las tensiones, reveladas por autoridades de servicios públicos que atienden personas vulnerables, en su relación de colaboración con OSFL (Organizaciones Sin Fines de Lucro), para alcanzar tal horizonte. El objetivo de nuestra investigación es determinar el impacto de hábitos alimenticios en el desempeño académico. Fue evaluada los hábitos alimenticios según instrumentos validados y establecido su normalidad con Shapiro-Wilk W=0.97 y significancia p-valor=0.34. Tenemos que el consumo alimenticio también tiene distribución normal e impacta en el desempeño académico con una correlación de Pearson de 0.24 y significancia p-valor=0.04. La regresión logística establece el punto de corte de consumo igual a 38 para tener la probabilidad de un 50% de buen (...) desempeño académico. Asimismo, la estimación puntual de desempeño académico correspondiente a este corte de consumo 38 es el puntaje de 14. (shrink)

En particular, es necesario un enfoque que tome en cuenta la importancia de los procesos de aprendizaje involucrados en el logro de niveles de competitividad de las empresas y que coloque el acento en los procesos de cambio y de innovación, adoptando una visión dinámica. Teniendo en cuenta ello, en el presente artículo (...) se presenta una visión teórica alternativa de la construcción de ventajas competitivas y de la competitividad de las naciones, a través de la moderna economía evolucionista e institucionalista. Así, se presentan los principales rasgos de la teoría evolucionista de la empresa y el enfoque de Sistema Nacional de Innovación, que posibilita un abordaje sistémico del fenómeno de la competitividad y el desempeño económico de las naciones. En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. In this short comment I discuss some aspects of William Duica's interpretation of Davidson's epistemology in a recent book. After a brief review of the book, I focus on three central issues of Duica's interpretation. First, I argue that his reading of Davidson's criticism of the scheme/content dualism is too restrictive and leaves open the possibility of an empiricist direct realism. Second, I argue in his reading Duica inadvertently commits himself to an empiricism of this sort and, as a result, his interpretation is in tension with Davidson's own coherentism. Finally, I discuss some aspects of Duica's interpretation of Davidsonian triangulation. (shrink)

El objetivo de nuestra investigación es determinar el impacto de demanda de trabajo y recursos psicológicos en el desempeño profesional. Fue evaluada la calidad laboral según instrumentos validados y establecida su normalidad. Tenemos que los recursos psicológicos y demanda de trabajo impactan en el desempeño profesional con una correlación múltiple de Pearson de 0.91. La correlación de Pearson entre calidad laboral y desempeño profesional fue de 0.69 y p valor de 0.004. La correlación de Spearman entre recursos psicológicos y desempeño (...) profesional fue de 0.735 y p valor de 0.002. (shrink)
